TERMS AND CONDITIONS

SECTION 1 – TERMS OF SERVICE   

These Terms and Conditions (“Terms”) explain the business-related terms, rules, and conditions of our services through our official platform which include our websites https://www.gmedoc.com and https://www.gmedoc.de (hereafter called “platform” and “website”). Although, the website https://www.gmedoc.de has an introductory interface for doctors and it is also closely linked to the website https://www.gmedoc.com, but in terms of operational and managemental terms, both websites are different from each other.  Throughout the website, the terms “we”, “us” and “website” refer to the GmeDOC’s platform and in some instances towards our company Talent hof Ug Haftungsbeschränkung (“Company”) and its partners. Through our platform, we offer information, tools, and services available to you, the “user”, “you”, “you” and all these tools, information, and services (collectively called “services”) are conditioned upon your acceptance of the rules, terms, conditions, and notices stated on and through the website.

By using our platform and its services, you agree to be bound by the following Terms, including those additional terms and conditions and policies referenced herein and/or available via hyperlink. These Terms shall apply to all users of the website, including without limitation users who are patients, doctors, visitors, clients, businessmen, representatives of companies or organizations, browsers, vendors, customers, merchants, and/ or anyone who has accessed our website.

SECTION 2 – EXPLANATIONS

Unless otherwise specified the terms contained in our website shall mean the following.

1. “Cancellation” means the cancellation of the service between the patient and the doctor.
2. “Commission” means the amount in percentage charged from the patients. Currently, it is set at 15% of the total amount.
3. “Company” shall mean Talent hof Ug Haftungsbeschränkung.
4. “CCPA” means California Customer Protection Act.
5. “Copyright” means the intellectual rights of GmeDOC’s website as explained in our Copyright and Intellectual policy.  
6. “Doctor” means the doctor registered on our platform for the purpose of providing his/her services.
7. “EEA” means European Economic Area as defined in our Privacy Policy.
8. “GDPR” means “General Data Protection Regulations as described in our Privacy Policy.
9. “Payment Methods” mean the methods under which the funds can be deposited on our website.
10. “Patient” means the user who is obtaining the services of the doctor.
11. “Platform” means our websites https://gmedoc.com and https://gmedoc.de through which we will offer our services.
12. “Price” means the total price of the services obtained through our website.
13. “Service” means the service attainable through our website.
14. “User” means anyone who is registered on our website. This includes the designer, freelancer, independent contractor, buyer, doctor , patient and other users.

SECTION 3- REQUIREMENTS

3.1. Age Requirement

You must be at least 18 years old to use our services. If you are under, you do not have permission to use our website.

3.2. Not Barred By Law

 You must otherwise not be barred by law from using the internet, apps, and social interactive platforms and applications for any reason whatsoever. 

3.3. Personal Information Requirement For Registration

To provide our users, the best services we may need personal information. This personal information may include your e-mail, payment and other information. Please read further about this in our Privacy Policy.  

SECTION 4 – PAYMENT, SHIPPING, AND REFUND POLICY

Patients can pay for their purchases through credit cards, debit cards which will be processed through PayPal and Stripe. All the payments will be made according to our payment policy. Please note that we reserve the right to change, remove or modify any of the payment methods at our sole discretion without giving any prior notice. We are not accepting any other payment method. We will update through notification if and we start accepting other payment methods.

4.1 – Rules Of Our Payment Policy:

1. The prices vary from appointment to appointment and depend on the particular doctor and his/her experience, expertise, time, and quality. We do not control the prices determined by the doctors.  
2. The structure of the prices will be Pay Per Appointment. The buyer will pay in advance.
3. The mode of payment will be through PayPal, Stripe, credit card, and debit cards. 
4. The patients will pay 15% as a commission fee to the GmeDOC’s website as service charges. These charges will be non-refundable whatever the case may be.
5. All of the amounts of the orders/projects will be held by our website as acting for both patient and designer until the appointment/meeting between the patient and doctor is successfully completed. 
6. After the completion of a successful order, the total net amount will be transferred to the doctor’s account.

SECTION 5 – COPYRIGHTS OF GMEDOC   

All website and platform content included on our websites, such as photos, logos, design, graphics, texts, layout, button icons, images, audio clips, videos, any possible download, data compilations, and software, is the property of GmeDOC and Talent hof Ug Haftungsbeschränkung, third-party content providers, or licensors and protected by German and international intellectual property protection laws. All software used on this website for the purpose of management and scheduling is the property of Talent hof Ug Haftungsbeschränkung. Our trademarks, service marks, trade names, service names, and trade dress may not be used in connection with any product or service that is not ours in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits us. All other trademarks, service marks, trade names or service names not owned by us that appear on this site are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by us.

5.1. Grant Of Limited License.

All users (including patients, doctors and general uses) hereby granted a limited license for the purpose of using our website’s services. Users have the authority to share the website’s links and our website on their social media platforms within certain limits. You affirm, confirm and agree that you will not exploit any portion of our service and you are not authorized to use any of the services unless you have acquired prior written permission from us.

SECTION 6 – USERS RIGHTS, LIMITATIONS AND OBLIGATIONS

6.1. Doctors’ Obligations

1. All doctors will provide the website of GmeDOC with the correct information about them. This information will include all the accurate and correct documents, certificates and other records related to practice and doctor’s profession.
2. All documents must be valid and should not be expired and in case of any renewals, newer documents and documents should be submitted to the GmeDOC’s management.
3. Any violations of the above-mentioned rules will result in severe penalties and bans to the doctors which may result in the freezing of the doctor’s accounts and reporting to the relevant authorities
4. If a patient agrees that his/her medical records can be used for research and educational purposes, the relevant doctor must contact the GmeDOC’s management in order to preserve the company’s copyright and literary rights and the website’s name in scientific contribution.

6.2. Doctors Limitations

1. The doctor cannot disclose any private and personal information to any patient.
2. The doctor is not allowed to attend the video call except with the knowledge and consent of the patient while filling out the request for a video appointment from the website.
3. It is not permissible to do any recording part or all of the video call and not to keep an image on it of the messages recorded between the doctor and the patient.
4. The doctor is not entitled to use any information or document obtained from the patient for personal or professional purposes outside the specified case. None of the information can be used in research, teaching, lectures or other areas until specifically permitted by the website management which will take necessary precautions in obtaining the permission of the patient through e-mail or in writing.
5. The doctors cannot use the name, logo or credentials of GmeDOC’s website unless it has been approved by the website’s management.
6. Management of the website does not advise the doctors to write official reports or have an official nature or may entail official matters related to GmeDOC.
7. The doctors are also advised to not write specific prescriptions. Instead, it is recommended that the doctors should advise the patients to use general and normal medicines and substances.
8. The forms must be filled out and confirmed within 48 hours.
9. The doctors should specify all the details accurately. It is not permitted for doctors to opt for the medical field that is not their specialty.

6.3. Patient’s Rights And Obligations

1. If a patient has received any immoral or illegal request from the doctor that is not related to the medical field will be dealt with severe consequences. The patient is advised to report or complain about such requests to the management of the website. The website will take the action against such complaints by blocking and reporting any such doctor.
2. If any doctor advises a patient to visit his or her private clinic or hospital, the patient has a right to inform the website’s management. In any case, the website shall not be held liable (legally, financially and medically) for any problem, liability or any unfortunate event that may result from a patient’s private visit to the doctor’s place, office or hospital.

6.4. Patient’s Limitations

1. The patient has no right to question the GmeDOC’s website or the doctor or accuse them in any material or legal form of any medical error received through letters, mail, medical report or video call.
2. The medical report of a patient can only be requested from the doctor who is familiar with the patient’s condition. This report is just suggestions to facilitate the preservation of medical terms and facilitate your treatment journey. GmeDOC’s management does not recommend that this report should be used definitively or decisively in any surgical procedure, dispensing of medications or neglecting any treatment.
3. The medical report of any doctors from GmeDOC’s website cannot be used to take official sick leave and is not considered an official document of any party or anything that may lead to any action.
4. Make a disgraceful, offensive or racist comment to anyone on the website management team or a registered doctor on the website, social media accounts, or write a publication or comment in any of the paper or electronic newspapers or social media sites in all its forms
5. To attack a doctor in a way that is not appropriate in words or indeed through chat messages, e-mails or videocalls.
6. Patients cannot misuse medical reports by:
   1. using them for unauthorized official purposes;
   2. raising funds through the medical report given through the site in any way; and

• falsifying all or part or using any part (logo, name, design or any other content) of the site.

SECTION 7 – SERVICE DISCLAIMER

We will not be liable in any amount for failure to perform any obligation under these Terms if such failure is caused by the occurrence of any unforeseen event beyond its reasonable control including without limitation Internet outages, communications outages, fire, flood, strike, emergency situations, lockdowns, war or act of God.
To the maximum extent permitted by law, GmeDOC and Talent hof Ug Haftungsbeschränkung exclude liability for any loss or damage of any kind howsoever arising, including without limitation any direct, indirect or consequential loss whether or not such arises out of any problem you notify to us and we shall have no liability to pay any money by way of compensation, including without limitation all liability in relation to:

1. Any interruptions to or delays in updating the website.
2. The infringement by any person of any Intellectual Property Rights of any third party caused by their use of the website.
3. Any loss or damage resulting from your use or the inability to use our website resulting from unauthorized access to, or alteration of your transmissions or data in circumstances that are beyond our control.
4. Any loss of profit, wasted expenditure, corruption or destruction of data or any other loss which does not directly result from something we have done wrong.
5. Any amount or kind of loss or damage due to viruses or other malicious software that may infect a user’s computer equipment, software, data or other property caused by persons accessing or using content from the website, or transmissions via emails or attachments received from us.
6. All representations, warranties, conditions and other terms which but for this notice would affect.

7.1 – Electronic Communications Disclaimer

No responsibility will be accepted by GmeDOC and Talent hof Ug for failed, partial or garbled computer transmissions, for any computer, telephone, cable, network, electronic or Internet hardware or software malfunctions, failures, connections, availability, for the acts or omissions of any service provider, internet accessibility or availability or traffic congestion or unauthorized human act, including any errors or mistakes.

By using our website and our services the users (including buyers and users) agree and acknowledge that all users act and provide services independently and none of the users are, for any purpose, employees of our website and company. Users do not have the authority to enter into agreements or contracts on behalf of our company or website, and shall not represent that they possess any such authority. Similarly, we have no authority over the users’ personal work schedules. Users have the freedom to conduct businesses with whoever they want. Therefore, all users of our services admit, affirm, and confirm that our website/platform is only acting as an independent marketplace and all users are responsible themselves for their own dealings and business activities.

SECTION 8 – WEBSITE’S POWERS, OBLIGATIONS, AND RULES

1. The website acknowledges that it will not disclose any information about any patient to any third party, whatever it may be. The patients’ information is considered confidential and it can only be viewed, reviewed, watched and seen after the formal complaint has been filed by the patient himself/herself.
2. The website of GmeDOC and Talent hof Ug Haftungsbeschränkung shall not be blamed for any medical error from any of the doctors, nor does the website or the company can be blamed for any material or moral burden as a result of the misuse of its electronic platform by patients and doctors.
3. The website is empowered to test the credentials of the doctors randomly by taking samples of the identification papers (license, certificated and educational records) to practice medical professions as a treated human doctor from registered doctors, and disclose their authenticity.
   1. Normally, up to 30% of the samples can be taken randomly at any given time from the previous un-verified doctors.
   2. If any fraud or manipulation is proven if the license to practice in the doctor’s registration data is incorrect or expired, he will be notified immediately and his accounts will be frozen pending a proper license within 30 days of the date of the warning. If fraud, manipulation, incorrectness or expiry of a license to practice the profession are proven, the doctor will be reported to the relevant authorities on account of malpractice.
4. Our website has the right to terminate, ban, report and withhold the information of any user (including any patient or doctor) who performs inappropriately or goes against the general morality of the public. Furthermore, strict legal and penal actions can be taken against such users.
5. Direct communication between the patient and the doctor should not occur except through the website.
6. Any direct contact between the doctor and the patient by personal phone, e-mail or both, or personal meeting shall be considered a violation of the website rules and the management of the website will be authorized to take strict actions from any results that may appear from any such direct communications. Any penalty, rule, termination, withholding of funds or punishment resulting from direct communications will be permanent and non-appealable.
7. In the case of a dispute between the patient and the doctor regarding any complaint of deficiencies or errors in the medical diagnosis, an arbitrator of fully trusted doctors will be appointed from the management of the GmeDOC’s website and the matter will be decided, and the ruling of this arbitrator is final.
8. The management of the website has the right to block, terminate and warn against dealing with any service that has been confirmed as illegal, immoral, unqualifying or unethical.
9. The name of the company or site is not entitled to be used without the written consent of the company.

SECTION 9 – PROHIBITION

By using our platform either directly or indirectly, you agree that you will only use this service for the purposes within these terms of use and according to law, regulations and other guidelines which are either expressly or impliedly have been given.

9.1. By Using Our Services, You Understand That:

1. Accessing any of our resources by means other than we provide is prohibited. You agree that you will not access our website in any unlawful manner or any other unethical manner whichever it may be.
2. By accessing our website or and using it the users are responsible for maintaining the confidentiality of any login, registration, or any information associated with any account they access and use. Henceforth, users agree they are solely responsible for the activities that occur under their account.
3. It is prohibited to engage in any activity or business which may disrupt or interfere with our app’s content, our services, and our business.
4. You agree that you will not duplicate, copy, or counterfeit source code, logos, business models, products, videos, samples, services in any way nor will you sell them on your own.
5. By using our services, you agree that you are responsible for the consequences, losses, or damages that may directly or indirectly incur due to any unlawful, unethical, or unauthorized activity as explained above. For which you may be held responsible in the eyes of law.
6. You will report any unethical, illegal, or any other prohibited content to us.
7. The posting of copyright content and any other content which is considered the property of someone else is strictly prohibited and will not be tolerated and will lead to a warning.
8. Mentioning of black-hat or other unethical methods in the forums is prohibited. If someone is posting, other members should report it to the owner or admin of the forum.
9. When posting written or any other content makes sure that the content does not contain or install any viruses, worms, malware, Trojan horses, or other harmful or destructive content.
10. You will not upload, host or transmit any viruses, malware, adware, spyware, worms, Trojan horses, keystroke loggers, spyware, logic bombs, time bombs, or any other harmful programs or code which could adversely affect the use or operation of the app, website, our hardware or systems, or the computers, tablets, phones or other devices of any users or other third parties, or to upload any content or materials containing any such content.
11. You must not in any way or for any purpose that breaches these Terms or the terms of any of the documents of these Terms.

9.2. You Agree and Consent That You Will Not:

1. Break or infringe any copyright, trademark, or any other intellectual property law in any way or manner that may harm now or in the future to our business.
2. You will not chargeback the amount you already paid, doing so will result in an immediate ban which may last indefinitely.
3. Impersonate any person and use a fake name or gain access to anyone’s account in any way or manner that may deem unlawful.
4. You will not attempt to gain unauthorized access to our websites.
5. You will not tamper with any copyrighted material in any way.

SECTION 10 – INDEMNIFICATION

You agree that you fully and completely hold harmless, indemnify and release us and any of our services, our company, the owner(s), staff and team members, employees, consultants, affiliates, or anyone else affiliated with GmeDOC and Talent hof Ug Haftungsbeschränkung from any and all damages, causes of action, liability, suits, allegations, sums of money, claims and demands whatsoever, in law or equity, that you ever had, now have or will have in the future against us, arising from your participation in or in any way related to our website, general content and services, even if we were aware in advance of the possibility of any such claim.

Any personal information you post on or otherwise submit in connection with the purchase of products will be used in accordance with our Privacy Policy. Please refer to our Privacy Policy.
Our Privacy Policy is written according to the General Data Protection Regulation (GDPR) and the California Consumer Compliance Act (CCPA).
